Who is an adult patient with a legal guardian?

Adult patients with a legal guardian are patients that are 18 years or older who can not apply for or purchase medical cannabis on their own. Patients younger than 21 years must get approval from the Compassionate Use Board (CUB).

Who is a medical cannabis guardian?

A medical cannabis guardian is the court ordered legal guardian of an adult patient. Guardians manage their patient's medical cannabis account and buy medical cannabis for them.

How to apply for patient/guardian cards

You’ll apply for a guardian card in the electronic verification system (EVS). The EVS is an online database that holds all of the medical cannabis cards, recommendations, and purchase data for patients and medical providers. You must register in the EVS to apply for a medical cannabis card. Your patient's information is included in the guardian application.

You’ll get your own medical cannabis guardian card when the patient gets their medical cannabis patient card. Use your guardian card to buy medical cannabis for the patient.

For patients between the ages of 18 and 21, the medical provider will submit a petition to the Compassionate Use Board (CUB) after you submit the medical cannabis application in the EVS. The Utah Department of Agriculture and Food (UDAF) will send you an email with the CUB’s decision after they review the application.

Create an account in the EVS.

Submit your medical cannabis patient/guardian application in the EVS.

Click "+ add application"

Select "Utah resident" from the drop-down and "I am applying for an adult patient as their legal guardian". Then click "Next".

Enter the adult patient's information. Required information is marked with a red star. Then click "Next".

Click the "Upload files" button. Upload a copy of your court ordered guardianship papers by selecting a file from your computer or by dragging and dropping the file. Then click "Next".

Click the “Add caregiver button” if you’d like to have someone pick up your medical cannabis if you can’t go yourself. Enter their information and click the “Save” button.

Click the “Yes” if you’d like to have your medical cannabis delivered somewhere other than your house. Enter the information and click the “Save” button. You can add more than one delivery location.

Read the guardian acknowledgement statement and click the “Acknowledge“ box.

Read the medical research statement. If you want to opt out of medical research, click the “Opt out of medical research” box. Then click the “Submit for certification” button.

Meet with the patient's medical provider in-person.

Their provider will complete a medical assessment to figure out if medical cannabis is a good treatment option for the patient. If it is, they’ll submit a certification in the EVS that verifies the patient meet the qualifications to get a medical cannabis card.

If the patient is between the ages of 18 and 21, they'll also send a request for the Compassionate Use Board (CUB) to review the patient's medical cannabis application.

The Center for Medical Cannabis will review your application.

After your provider submits a medical cannabis certification, the application will be in "Awaiting state review". We will review your application as quickly as possible. It can take up to 10 business days.

You'll receive an email from [email protected] once your card has been approved.
Download your medical cannabis patient/ guardian cards from the EVS. You can print or save your card to your device.

You must show your card and valid ID each time you go to a medical cannabis pharmacy or get a medical cannabis delivery. Find a pharmacy or home delivery service.

Meet with a medical cannabis pharmacist.

You will meet with a medical cannabis pharmacist before your first medical cannabis purchase. This can be in-person at a medical cannabis pharmacy or through a video or phone call if the pharmacy has that option. Call the pharmacy to see if you need to schedule an appointment to meet with the pharmacist.

The pharmacist will talk with you about the patient's medical condition, symptoms, and health history to provide recommendations for products and amounts to try. They will also answer any questions you have.

Buy medical cannabis.

You can buy medical cannabis after you meet with the pharmacist. After your first purchase, you can buy from any Utah medical cannabis pharmacy or get home delivery.

Your medical cannabis card will last for 1 year.

Your provider may choose a shorter expiration date if they feel that will be best for the patient's medical condition. You can see your card’s expiration date in the EVS.
